Repair Notice

This notice is given to you under the Australian Consumer Law.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

Your device is capable of retaining user-generated data. The repair of your goods may result in the loss of that data.

Service Agreement

1. What you are authorising

You authorise BITS Perth to inspect, diagnose and test the device described above in order to identify the fault. You confirm that you are the owner of the device, or that you have the owner's authority to leave it with us for this purpose.

2. Quotes and approval

We will contact you with a quote before carrying out any chargeable repair work. We will not exceed a quoted amount without your approval. If you decide not to proceed after diagnosis, any diagnostic fee advised to you at the time of quoting remains payable, and the device will be returned to you in the condition it was received, so far as is practicable.

3. Backups and your data

Repair work can result in the loss of data, and some faults (particularly failing storage drives) carry a risk of data loss regardless of what we do. You are responsible for backing up your data before leaving the device with us. Where you ask us to attempt data preservation or recovery, we will use due care and skill, but we cannot guarantee that any particular data will be recoverable. Please tell us before drop-off if the device holds data you cannot replace.

4. Repair warranty

We warrant our workmanship, and any parts we supply, for 90 days from the date you collect the device. This warranty covers the specific repair we carried out. It does not cover new or unrelated faults, accidental damage, liquid damage, or issues caused by software changes, malware or misuse after collection. This warranty is in addition to – and does not limit – the rights and remedies you have under the Australian Consumer Law.

5. Our liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, including a guarantee that services will be provided with due care and skill. Nothing in this agreement excludes, restricts or modifies those guarantees. To the extent the law permits, our liability for any other loss is limited to resupplying the service, or paying the cost of having it resupplied. We are not liable for loss of data except to the extent it results from our failure to exercise due care and skill.

6. Collecting your device

We will notify you by phone, SMS or email when your device is ready. Please collect it within 60 days of that notification. We will attempt to contact you at least twice before that period ends, using the contact details you have given us below – so please keep them current. If the device remains uncollected after 60 days and we have been unable to reach you, you agree that we may dispose of it and that any outstanding charges remain payable. Where a device is disposed of, any data on it will be securely destroyed. You may ask us in writing at any time to hold the device for longer.

7. Payment

Payment is due on collection unless we have agreed otherwise in writing. We may retain the device until payment of our reasonable charges for the work performed on it.

8. Your personal information

We collect your contact and device details to carry out the repair, to contact you about it, and to keep a record of the work. We keep these records for seven years. We do not sell your personal information. You can ask to see or correct what we hold, or ask us to delete it, by emailing admin@bitsperth.com.au. Marketing emails are sent only if you opt in below, and every one of them carries an unsubscribe link.
